Anti-Spam Policy

Last Updated: September 3, 2024

Mefsakolud ("we," "us," or "our") is committed to maintaining a communication environment free from unsolicited, deceptive, or abusive messaging. This Anti-Spam Policy outlines the standards we enforce for all communications sent through or in connection with our platform at mefsakolud.biz. By using our services, you agree to comply with this policy in full.

1. Scope of This Policy

This policy applies to all users, participants, and account holders who send communications through our platform, including but not limited to email messages, group notifications, in-platform messages, and any automated or bulk communications initiated via our service infrastructure.

2. Definition of Spam

For the purposes of this policy, spam refers to any unsolicited, bulk, or indiscriminate electronic communication sent without the explicit consent of the recipient. This includes, but is not limited to:

  • Unsolicited commercial messages sent to individuals who have not opted in to receive them
  • Repeated or excessive messages sent to the same recipient or group without a legitimate purpose
  • Messages with misleading, false, or deceptive subject lines, sender information, or content
  • Automated messages sent without appropriate identification or opt-out mechanisms
  • Communications designed to harvest email addresses or other personal data
  • Messages promoting illegal products, services, or activities

3. Prohibited Practices

Users of our platform are strictly prohibited from engaging in any of the following:

3.1 Unauthorized Bulk Messaging

Sending identical or substantially similar messages to multiple recipients who have not provided prior, informed consent to receive such communications is prohibited. This applies regardless of the technical method used to send those messages.

3.2 Identity Misrepresentation

Falsifying sender information, using forged headers, impersonating another individual or organization, or otherwise misrepresenting the origin of any message is strictly forbidden.

3.3 List Harvesting and Scraping

Using our platform or its infrastructure to collect, scrape, or compile email addresses or contact information without the express permission of the individuals concerned is prohibited.

3.4 Circumvention of Opt-Out Requests

Continuing to send messages to recipients who have explicitly requested to be removed from a mailing list, or otherwise disregarding unsubscribe requests, is a violation of this policy.

3.5 Use of Third-Party Lists Without Consent

Importing or using contact lists obtained from third parties where verifiable, explicit consent from each contact cannot be demonstrated is prohibited.

4. Consent Requirements

All bulk or marketing communications sent through our platform must be based on a lawful consent basis. Acceptable consent includes:

  • Express opt-in: The recipient has actively and knowingly agreed to receive communications, typically through a sign-up form or explicit checkbox
  • Confirmed opt-in: The recipient has confirmed their consent through a secondary action, such as clicking a verification link

Pre-checked boxes, implied consent without a clear action, and purchased lists do not constitute valid consent under this policy.

5. Required Message Elements

Any bulk or commercial communication sent through our platform must include the following:

Requirement Description
Sender Identification A clear and accurate identification of the individual or organization sending the message
Physical or Mailing Address A valid, current postal address associated with the sender
Unsubscribe Mechanism A clearly visible and functional method for recipients to opt out of future communications
Honest Subject Line A subject line that accurately reflects the content of the message
Timely Opt-Out Processing Opt-out requests must be honoured within a reasonable timeframe, not to exceed ten (10) business days

6. Our Own Communications

Mefsakolud commits to applying the same standards to all communications we send on our own behalf. We will only contact users who have provided consent or with whom we have an existing service relationship. Every marketing or promotional communication from us will include a functional unsubscribe option. Transactional messages directly related to your account or service usage are exempt from unsubscribe requirements but will never be used as a vehicle for unsolicited marketing content.

7. Reporting Spam

If you believe you have received a communication that violates this policy, whether originating from our platform or using our branding without authorization, we encourage you to report it promptly. You may contact us at:

Email: [email protected]
Mailing Address: 43 Rue Principale, Bedford, QC J0J 1A0, Canada
Phone: +1 604 551 5192

When reporting, please include the full message headers, the sender address, the date and time received, and a copy of the message where possible. This information assists us in investigating and taking appropriate action.

8. Enforcement and Consequences

We take violations of this policy seriously. Upon identifying or receiving a credible report of a violation, we may take one or more of the following actions depending on the severity and nature of the breach:

  • Issuing a formal warning to the account holder
  • Temporarily suspending the ability to send communications through the platform
  • Permanently terminating the account without refund
  • Blocking specific IP addresses or domains associated with abusive activity
  • Reporting confirmed violations to relevant internet service providers or anti-abuse organizations
  • Taking legal action where applicable

We reserve the right to take immediate action without prior notice when the violation poses a risk to other users, our infrastructure, or our reputation.

9. Third-Party Integrations and Automated Systems

Users who connect third-party tools, APIs, or automation systems to our platform remain fully responsible for ensuring that all communications sent through those integrations comply with this policy. We do not assume liability for spam or unauthorized communications originating from integrations configured by users. It is the user's responsibility to ensure that automated workflows are configured lawfully and with appropriate consent.

10. Changes to This Policy

We may update this Anti-Spam Policy from time to time to reflect changes in our practices, applicable standards, or operational requirements. When material changes are made, we will update the "Last Updated" date at the top of this document. Continued use of our services following any such update constitutes acceptance of the revised policy. We encourage you to review this page periodically.
